Thus, following the Regulations concerning the Laws and Customs of War on Land, when an occupation is already in place (Western Bank and Gaza Strip), the occupying state (Israel) cannot use militarized force in response to an armed attack; it can only use police force to restore order.
Thus, it is unclear how Israel as an occupant can claim the right to self-defense when it has been controlling, policing and making settlements in the OPT since 1967.
So with respect to IHL principles and proportionality, Israel was obligated to refrain from using starvation as a tactic against Gaza’s civilians, minimize harm to civilians and civilian infrastructure, and allow the return of displaced individuals post-conflict. However, in contrast, Israel closed all borders and severed essential services like electricity, water, and food supplies, as well as conducting airstrikes on densely populated areas and vital infrastructure. Israel’s armed forces launched air strikes on residential buildings, including apartments in the Rimal neighborhood in Gaza City; mosques; refugee camps, such as Jabalia Refugee Camp and Nuseirat Refugee Camp); and the UNRWA School in Central Gaza’s al-Maghazi refugee camp.
Israel’s attacks, which caused a humanitarian catastrophe by collectively punishing the entire population of Gaza, failed to meet the standards outlined in the UN Global Counter-Terrorism Strategy. Furthermore, the extensive damage caused to civilian infrastructure, including schools, hospitals, and media outlets, highlights the disproportionate nature of the military operations and violates Article 57 of the Additional Protocol I to the Geneva Conventions.
I would still like to know how exactly you think what you did comment. It is telling that you apply the law to a non-state actor of a non-member observer state of the UN and actively do not apply any law to a full member signatory of the UN and Geneva Conventions, but please go on about the Geneva Conventions.

In fact, given the ridiculous power imbalance and the disproportionate power and scale, I would expect you would be spending almost all of your alloted condemn-war-crimes-time condemning the Israelis. Are you?
I'd like to but tbh it feels pointless to talk about the whole situation at this point. No one really seems interested in anything other than either Hamas bad or Israel bad. I know a long time ago I was saying that Israel could probably help people support their side more by ensuring that civilians remain unharmed as much as they possibly can. They have since gone in the opposite direction.
Or Israel could stop colonizing a people that doesn't want to be colonized. The West won't force them, because loves seeing Israel being a nuissance to the Mid East, and the Israelis themselves are degenerate. So let's not point the finger at the Pals when they lash out back at the Israelis.

War isn't a sport, it's not something that's going to be fair. In fact wars between factions that are equally matched go on for longer and result in a greater loss of life. Also it was known by everyone that Israel had significantly more military capability than Hamas, yet Hamas decided to massacre villages on October 7, 2023 which initiated the current iteration of hostilities, took hostages which necessitated ground operations (which result in higher civilian casualties) and did not wear uniforms in combat operations (which further increased civilian casualties and made it impossible to ever know how many casualties are civilian or combatant). The actions of Hamas was clearly done to maximize Palestinian casualties so they could have imagery they could use for propaganda purposes to get more money from international sources.
The sad thing is it worked, Hamas successfully monetized Palestinian suffering which means they have a profit motive to continue to do things which will cause more suffering in the future.
The Palestinian movement has become a hate movement, and those kinds of movements have historically been incapable of understanding how they're being manipulated. As long as you get your dose of dopamine from seeing suffering and expressing hatred, Hamas will continue to profit and continue to provide you imagery of suffering to keep the cycle going.
I don't think anyone here thinks Hamas is strongly committed to international law.

The post is referencing a war crime committed by Hamas. Yet people here are using it as if it's a big gotcha against Israel. Really warped view on things when you witness a war crime being committed and you're so blinded by hatred you just lazily criticize some phrasing around it because you don't even see the war crime any more.
The dehumanization that's being done here is disgusting. This is why the Palestinian movement isn't invited to speak in civil society anymore. Y'all are too warped by hatred.

If a person is operating a tank then they're a legitimate military target. It isn't a war crime to capture or kill a military target. Do you claim that Israel is committing war crimes and kidnapping when they capture enemy combatants? Of course not.
You may have a preferred side, but calling 'war crime' on something doesn't make it true. If you step into a tank and strap a rifle on your body then you are operating under an entirely different set of rules and are subject to be killed or captured by the opposing forces.
We saw how the state of Israel treats detained civilians. Not even fucking soldiers, but civilians.
